TTB Seeks Comments on Amendments Implementing Changes to the Definition of Hard Cider. On January 23, 2017, TTB published in the Federal Register a temporary rule, T.D. TTB–147, amending its regulations to implement changes made to the definition of "hard cider" in the Internal Revenue Code by the Protecting Americans from Tax Hikes Act of 2015. TTB Seeks Comments on Amendments Regarding Bond Requirements and Tax Return Filing Periods: On January 4, 2017, TTB published in the Federal Register a temporary rule, T.D. TTB–146, amending its regulations to implement section 332 of the Protecting Americans from Tax Hikes Act of 2015 (PATH Act), which amends the Internal Revenue Code (IRC) to change tax return due dates and remove bond requirements for certain eligible alcohol excise taxpayers. Through a concurrent notice of proposed rulemaking, Notice No. 167, TTB is soliciting public comments on the temporary amendments and several other related proposals. Notice No. 165, Proposed Addition of New Grape Variety Names for American Wines. TTB is proposing to amend its wine labeling regulations to add a number of new names to the list of grape variety names approved for use in designating American wines. TTB also is proposing to remove one existing entry and replace it with a slightly different name, and to correct the spelling of another existing entry. The proposed amendments would allow wine bottlers to use these additional approved grape variety names on wine labels and in wine advertisements. Notice No. 160, Proposed Revisions to Wine Labeling and Recordkeeping Requirements. TTB is proposing to amend its labeling and recordkeeping regulations in 27 CFR part 24 to provide that any standard grape wine containing 7 percent or more alcohol by volume that is covered by a certificate of exemption from label approval may not be labeled with certain information unless the wine is labeled in compliance with the standards set forth in the appropriate sections of 27 CFR part 4 for that label information. T.D. TTB-138, Civil Monetary Penalty Inflation Adjustment—Alcoholic Beverage Labeling Act. In this interim final rule and comment request, TTB is increasing the maximum civil monetary penalty for violations of the Alcoholic Beverage Labeling Act of 1988 from $10,000 to $19,787. This increase results from the Federal Civil Penalties Inflation Adjustment Act of 1990 and other laws. TTB Announces ITDS Pilot Test; Seeks Comments on Import Filing Instructions: In Notice No. 156, TTB announces a pilot program in which importers, U.S. Customs and Border Protection (CBP), and TTB will test, as part of the International Trade Data System (ITDS) initiative, the electronic collection of import data required by TTB and the transfer of that data through CBP to TTB. TTB is also requesting comments on a draft set of Automated Commercial Environment (ACE) Filing Instructions that describes how importers of distilled spirits, wine, beer, tobacco products, processed tobacco, or cigarette papers and tubes may file information electronically to meet TTB requirements at the importation of those commodities. Notice No. 147, Use of American Viticultural Area Names as Appellations of Origin on Wine Labels. In this notice, TTB proposes to allow the use of American Viticultural Area (AVA) names as appellations of origin on labels of wines that have been fully finished within a State adjacent to the State in which the AVA is located. Current regulations require wines labeled with an AVA appellation of origin to be fully finished within the State in which the AVA is located. The proposal would be consistent with the current TTB requirements for use of a State name as an appellation of origin on wine labels.
