This week’s top news includes a new statement on using hemp ingredients in alcohol beverages, an opportunity to attend one of our educational seminars on trade practices, and an announcement about new FAQs at our CBMTRA page. TTB ISSUES INDUSTRY CIRCULAR ON FORMULAS CONTAINING INGREDIENTS DERIVED FROM HEMP IN RESPONSE TO THE 2018 FARM BILLOn April 25, 2019, we published TTB Industry Circular 2019-1, Hemp Ingredients in Alcohol Beverage Formulas. Since the Agriculture Improvement Act of 2018 (the 2018 Farm Bill) excluded “hemp” from the definition of marijuana under the Controlled Substances Act (CSA), we have received many inquiries from industry members about whether they may produce alcohol beverages containing ingredients derived from “hemp,” such as cannabidiol (CBD). After consultation with FDA, we have determined that, at this time, we will return for correction any formulas with ingredients derived from “hemp” (other than ingredients derived from hemp seeds or hemp seed oil). Applicants have the option to resubmit the formula upon receipt of a favorable individual determination from FDA on the regulatory status of their ingredients.
