IN THIS ISSUE Greetings! This week we’re highlighting information for distilleries about when a COLA is and is not required, and how to access and file TTB forms. HOT TOPIC: IF I AM ONLY SELLING MY BOTTLED DISTILLED SPIRITS PRODUCT IN-HOUSE, DO I STILL NEED TO GET A COLA FOR IT?This question has been coming up frequently on our call centers, so we are providing our existing guidance on this topic here. The short answer is, if your product doesn’t enter interstate commerce, it is not required to comply with the labeling or COLA requirements found in 27 CFR part 5, but you are required to obtain a certificate of exemption from label approval. TTB FAQ S14 contains more information on this topic, as well as related subjects, such as if the formula and standards of fill requirements apply. Labels. If you are bottling spirits that are not to be sold, offered for sale, or shipped or delivered for shipment, or otherwise introduced into interstate commerce, you may apply for a certificate of exemption from label approval. TTB FORMSAlthough the majority of the most frequently used TTB forms can be filed online through COLAs Online, Formulas Online, Pay.gov, Online Claims Submission, and Permits Online, not all required forms can be submitted electronically. In addition, we understand that not everyone has reliable internet service to support filing online. While we strongly encourage the use of our online filing systems, if you need to use paper forms you can view and download them from our website on the TTB Forms page. |
