What is Privacy Act

The Privacy Act of 1974, as amended, provides safeguards against unwarranted invasions of privacy through the misuse of records by Federal agencies by restricting disclosure of personally identifiable records maintained by agencies; granting individuals increased rights of access to records maintained about them; granting individuals the right to seek amendment of records maintained about them upon a showing that the records are not accurate, relevant, timely or complete; and establishing a code of "fair information practices" which requires agencies to comply with statutory norms for collection, maintenance, use and dissemination of records. The Treasury regulations which implement the Act are found at 31 CFR Part 1, Subpart C. Section 1.26.

To increase transparency and assure notice to individuals, the Privacy Act requires agencies to publish in the Federal Register notice of modifications to or the creation of systems of records. The term "system of records" means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual. TTB's System of Records, along with updated routine uses and claimed exemptions, can be found at System of Records Notice (SORN).

Please be advised TTB processes requests for records under both the Privacy Act and the Freedom of Information Act in order to provide the greatest amount of access. For additional information about how to submit a Privacy Act Request, visit: Making a Perfected Privacy Act Request.
